Terms and Conditions of Membership

In signing this Agreement, you fully understand and accept that this membership agreement automatically renews under the existing fees, terms and conditions at the expiration date of this agreement and is subject to change at the sole discretion of SBG NORTH TYNESIDE management. You may terminate this agreement only if you do so with 30 days written notice. 2. Fees may vary depending on the type of membership, place of purchase, and/or time of purchase. Your fees or dues rate is specified in this Agreement. Unless otherwise specified, all fees are exclusive of applicable taxes. 3. You may upgrade your membership for additional benefits by paying an upgrade fee. Payments made on a prior membership may not be applied to future obligations after the upgrade date. Fixed-term memberships include processing fees and monthly dues. Payments are settled via Stripe. SBG NORTH TYNESIDE reserves the right to adjust monthly dues once per calendar year upon written notice. Memberships automatically renew unless terminated as specified in clause 9. 4. SBG NORTH TYNESIDE immediately earns initiation and processing fees, along with the first month’s dues, upon membership purchase. Fees are non-transferable and non-refundable, regardless of usage. 5. All monthly or periodic fees are charged and payable in advance. SBG NORTH TYNESIDE may take legal action to recover outstanding payments, and members will indemnify SBG NORTH TYNESIDE for associated costs, including legal fees. 6. SBG NORTH TYNESIDE reserves the right to open new locations or relocate gyms with 30 days notice. 7. Temporary closures for maintenance or unforeseen events do not affect this Agreement. For closures exceeding 30 days with no alternative SBG NORTH TYNESIDE within 10 miles, memberships will be extended accordingly. 8. Only authorised SBG NORTH TYNESIDE staff may provide services such as classes, workshops, or personal training. Soliciting or providing services within SBG NORTH TYNESIDE premises is strictly prohibited. 9. This Agreement may be terminated by SBG NORTH TYNESIDE (i) at any time if you breach this Agreement; or (ii) 30 days after SBG NORTH TYNESIDE delivers written notice of termination to you. This Agreement may be terminated by you (or your estate) by delivering written notice of termination to SBG NORTH TYNESIDE: (a) in the event of your death during the term of membership; (b) if you become disabled (i.e., a condition that is verified in writing by a physician, which precludes you from physically using the facilities) during the membership term and provides written evidence thereof (including a writing verified by a licensed physician) to SBG NORTH TYNESIDE.10. Members must behave respectfully toward staff, members and property. Disruptive, aggressive, or unsafe behaviour may result in suspension or termination of membership. 11. Members must adhere to all health and safety protocols, including hygiene measures. Non-compliance may result in denied access or termination of membership. 12. Temporary suspension for medical, travel, or other valid reasons may be requested, subject to prior approval and payment of a suspension fee. Suspensions may not exceed 2 months within a 12-month period. 13. Members may bring one guest per visit with prior approval and payment of a guest fee. Guests must adhere to all SBG NORTH TYNESIDE rules and guidelines. 14. Refunds for prepaid services, such as workshops or private lessons, are available only if cancellation is requested at least 24 hours in advance. Refunds are issued as credit at SBG NORTH TYNESIDE’s discretion. 15. By signing this Agreement, you agree to the Privacy Policy at www.sbgnorth.co.uk/privacy-policy, including the collection, use, and disclosure of personal data. SBG NORTH TYNESIDE is not liable for data breaches caused by third parties. 16. SBG NORTH TYNESIDE reserves the right to amend these terms, the Privacy Policy, and other policies with immediate effect. 17. If any provision is deemed invalid, the remaining provisions remain enforceable. 18. This Agreement supersedes all prior agreements and representations.

Disclaimer of Liability

19. You warrant and represent that you are in good physical condition and have no medical reason or impairment that might prevent you from your intended use of the SBG NORTH TYNESIDE facilities or that might be detrimental to your health, safety, comfort, or physical condition. You confirm that SBG NORTH TYNESIDE did not give you any medical advice before you joined and understand that SBG NORTH TYNESIDE cannot at any time give you any advice relating to your physical condition and/or ability to use the SBG NORTH TYNESIDE facilities. If you have any health or medical concerns now or after joining, you should consult with your physician prior to using the SBG NORTH TYNESIDE facilities. You agree that it is your personal responsibility to ensure that you are in a healthy and physically fit condition before commencing any exercise routine and you shall ensure that you conduct such exercise routine in a safe and careful manner. You agree that SBG NORTH TYNESIDE may, at any time and in its sole discretion, require you or your guest(s) to make such declarations in respect of your or your guest’s health, physical condition, travel history, and/or such other details as SBG NORTH TYNESIDE may consider necessary. In the event of a medical emergency, SBG NORTH TYNESIDE may, at its sole discretion, arrange for medical assistance or emergency services, and you agree that SBG NORTH TYNESIDE shall not be liable for any resulting injury, illness, or death. 20. Participation in the activities and the use of the facilities at SBG NORTH TYNESIDE naturally involves the risk of injury to you or your guest(s), whether caused by you or someone else. You understand and acknowledge that activities and the use of the facilities at SBG NORTH TYNESIDE naturally involve close physical proximity to other persons, members, and/or guests, and may involve attendant risks of injury and/or illness to you or your guest(s). Specific risks vary from one activity to another, and the risks range from minor injuries to catastrophic injuries, including death. In consideration of your participation in the activities and use of facilities offered by SBG NORTH TYNESIDE, you understand and voluntarily accept this risk and agree that SBG NORTH TYNESIDE, its related corporations, and each of their officers, directors, employees, students, volunteers, agents and independent contractors will not be liable for any death or injury, including, without limitation, personal, bodily, or mental injury, illness or disease, economic loss, indirect, special, incidental, or consequential damages, or any other damage, to you, your spouse, guests, or unborn child arising out of, or in connection with, your or their (as the case may be) use of any SBG NORTH TYNESIDE services, facilities, or premises, whether related to exercise or not. Further, you understand and acknowledge that SBG NORTH TYNESIDE does not manufacture fitness or other equipment at its facilities but purchases and/or leases equipment. You understand and acknowledge that SBG NORTH TYNESIDE is providing fitness services and may not be held liable for defective products. 21. You agree that you will not make any unfavourable or prejudicial statements to any person (save where such statements are made in confidence to professional advisers for the purpose of obtaining professional advice, provided that the statements shall remain in confidence, or where required by law) relating to the affairs of SBG NORTH TYNESIDE or to your participation in the activities and use of the facilities offered by SBG NORTH TYNESIDE. You agree that you will not disparage or otherwise make any statement or comment unfavourable or prejudicial to SBG NORTH TYNESIDE in any medium and on any platform, including on social media, without the prior written consent of SBG NORTH TYNESIDE. Disparagement includes false or misleading statements that may harm SBG NORTH TYNESIDE’s reputation or operations. 22. You agree to indemnify and hold harmless SBG NORTH TYNESIDE, its related corporations, and each of their officers, directors, employees, volunteers, and independent contractors (each an “Indemnified Person”) against any losses, damages, liabilities, claims, costs, and expenses (including legal fees and expenses on a full indemnity basis) that are: (a) brought against or incurred by such Indemnified Person for any injuries or claims mentioned in clause 2 above; and/or (b) incurred by such Indemnified Person arising from any claim made against an Indemnified Person by another member, arising as a result of or in connection with any act, omission, negligence, or default by you or your guest(s). 23. You are solely responsible for the safekeeping of your belongings. SBG NORTH TYNESIDE is not liable to you or your guests for any personal property that is damaged, lost, or stolen while on or around SBG NORTH TYNESIDE premises, including but not limited to a vehicle or its contents or any property left inside.

Assumptions of Risk

Because of the nature of martial arts – and unarmed combat training – combined with martial arts based fitness training, you will be exposed to many potential risks throughout your time training with SBG NORTH TYNESIDE. These include, but are not limited to, slips, trips, sprains, falls, cuts, abrasions, contusions, swelling and in some more uncommon cases, breaks and other injuries. Whilst the club implements stringent safety measures and has an outstanding safety record, it’s important to us that you understand the nature of what you are about to participate in, and that you are happy to assume all risks having been made aware in advance of what these might be.

We train in a combination of unarmed combat disciplines – Brazilian Jiu Jitsu, Kickboxing, Wrestling and combined into Mixed Martial Arts. We also combine fitness drills into most of our training, with some key martial arts based fitness and martial arts based conditioning too.

You always have the right to stop training at any point should you not feel comfortable performing any set technique or exercise, and you are under no pressure to complete any drill, technique or exercise if you do not wish to.

If you do continue with this class and any subsequent classes we ask that you take a moment to consider the nature of an intense combat class and what that might entail, including the above possible risks as identified – and any other potential injuries, such as contact during sparring, concussion, breaks and others. These are very uncommon – but they can occur. Please ensure you’re happy to assume the inherent risks that come with training in martial arts.

You are welcome and encouraged to speak to your instructor if you’re not completely at ease with the risks being assumed, or not completely confident about what our classes entail.
